Terms of Commercial Service & Operational Warranty

Effective Date: January 1, 2026 | Operating Entity: Commercial Garage Door Repair LLC

These Terms of Commercial Service govern all business-to-business repairs, preventative maintenance contracts, hardware replacements, and emergency dispatch services rendered by Commercial Garage Door Repair LLC to commercial facility owners, tenants, property managers, and general contractors.

1. Commercial Scope of Work & Authorizations

All service requests, emergency dispatch orders, and commercial hardware replacements executed by Commercial Garage Door Repair LLC are governed by written B2B work order authorizations, purchase orders, or formal Master Service Agreements (MSAs). Prior to commencing physical labor, our field supervisors review equipment diagnostics with on-site facility personnel and execute written scope authorizations.

Any modifications, unforeseen structural framing deficiencies, or additional components required to complete safe mechanical operation will be documented on an amended work order and submitted to authorized facility representatives for electronic or written approval prior to component installation.

2. Commercial Hardware Warranties & Performance Guarantees

Heavy-duty commercial components installed by our certified technicians carry extensive manufacturer and labor warranties. High-cycle ASTM A229 oil-tempered duplex and triplex torsion springs carry verified cycle-life performance warranties against premature metallurgical shear fracture. Replacement rolling steel curtain slats, structural angle tracks, and industrial jackshaft operators are warranted against manufacturing defects and workmanship errors for a period of twelve (12) months following installation.

Warranty coverage is strictly contingent upon regular professional maintenance and operation within specified DASMA cycle limits. Warranties do not cover damage resulting from forklift collisions, building structural settling, deliberate tampering, unauthorized third-party modifications, or severe environmental disasters exceeding standard engineering ratings.

3. Emergency SLA Dispatch Terms & Force Majeure

Our guaranteed 2-hour priority emergency SLA applies to commercial facilities situated within primary metropolitan logistics corridors. While our mobile units maintain dedicated standby availability, arrival windows are subject to severe weather disruptions, regional transit emergencies, civil infrastructure closures, and force majeure events beyond reasonable commercial control.

Neither party shall be held liable for failure or delay in performance resulting from acts of God, extreme hurricane or tornado warnings, severe flooding, regional power grid failures, strikes, or government-mandated travel restrictions. In such events, our dispatch coordinators will establish emergency communication with facility contacts to reschedule service at the earliest safe opportunity.

4. Net-30 Billing, Invoicing & Payment Obligations

Commercial accounts approved for Net-30 invoicing agree to remit full payment within thirty calendar days from invoice presentation. Past-due balances are subject to statutory commercial finance charges of 1.5% per month (or the maximum allowable rate under state law). Unpaid accounts may forfeit commercial warranty coverage until billing reconciliation is finalized.

Non-credit accounts, one-off emergency dispatch calls, and initial emergency responses must be secured with an authorized corporate credit card or verified ACH guarantee prior to technician dispatch. The client agrees to reimburse Commercial Garage Door Repair LLC for all reasonable collection agency fees, court costs, and attorney fees incurred in collecting outstanding balances.

5. Facility Owner Responsibilities & Site Access Standards

Facility owners and managers are responsible for providing clear, unobstructed physical access to the overhead doors, operators, and loading dock bays designated for service. A minimum clearance buffer of ten (10) feet around the operating area must be maintained, and any active warehouse machinery or conveyor systems interfering with safe staging must be de-energized.

Facility representatives must designate an authorized on-site contact person possessing signature authority to review completed work, inspect mechanical operation, and sign digital completion receipts upon conclusion of service.

6. Limitation of Commercial Liability & Consequential Damages Waiver

To the maximum extent permitted by applicable commercial law, Commercial Garage Door Repair LLC shall not be liable for incidental, special, punitive, indirect, or consequential damages arising from door or dock equipment downtime. This waiver includes, but is not limited to, claims for lost commercial revenue, business interruption, cargo spoilage, driver or carrier detention charges, or production schedule delays.

The total cumulative liability of Commercial Garage Door Repair LLC for any claim arising out of or related to commercial services rendered shall not exceed the total monetary sum paid by the commercial customer for the specific service work order under which the claim arose.

7. Governing Law, Venue & Commercial Dispute Resolution

These terms and conditions are governed by and construed under the laws of the State of Texas, without regard to conflicts of law principles. Any legal disputes or claims arising out of commercial service agreements shall be resolved exclusively through binding commercial arbitration administered by the American Arbitration Association (AAA) in Harris County, Texas.
